Title IX Regulations: Their Status and Interaction with Pennsylvania Anti-Discrimination Laws

(Jan. 29, 2025) The Title IX 2024 regulations were vacated by a federal district judge on Jan. 9, 2025, effectively reinstating the 2020 regulations nationwide. This change does not eliminate the rights and protections of Title IX but impacts how the law will be enforced in schools. In addition, Pennsylvania public schools are still subject to prohibitions on sex discrimination that include gender identity and expression under Pennsylvania state law.

School districts are now required to follow the 2020 Title IX regulations. The 2020 regulations’ preamble affirms that the U.S. Education Department “will not tolerate sexual harassment … against any student, including LGBTQ students.”
